This bill amends the eligibility requirements for certain criminal defendants to obtain an order of nondisclosure of their criminal history record information. Specifically, the bill changes the waiting period for misdemeanor offenses from the second anniversary to the 180th day after the discharge and dismissal of the deferred adjudication community supervision. For felony offenses, the waiting period is reduced from the fifth anniversary to the first anniversary of the discharge and dismissal. Additionally, the bill establishes new procedures for individuals who were placed on community supervision or convicted of certain non-violent felonies, allowing them to petition the court for an order of nondisclosure if they meet specific criteria, including having no prior convictions or orders of nondisclosure, with some exceptions. The bill takes effect on September 1, 2021.
