This Resolution requests the Office of Information Practices (OIP) to establish a working group to create a recommendation for a new law regarding "deliberative and pre-decisional agency records," which are internal documents created during the decision-making process before a final decision is made. The goal is to find a balance between the public's right to access government information and the need for agencies to have frank internal discussions to make sound decisions. The working group will consist of seven members: three from public interest groups, three from government agencies, and the Director of the OIP or their designee, who will lead the group. This group will examine existing laws and practices in Hawaii and other places, gather input from stakeholders, and report its findings and recommendations to the Legislature by early 2023.
