This bill amends the civil rights law to make the personnel records of police officers, firefighters, correction officers, and probation officers confidential and not subject to public inspection or review without the express written consent of the individual, except as may be mandated by a lawful court order. The bill sets forth a process for obtaining a court order to review such records, requiring the judge to review the request and give interested parties an opportunity to be heard before determining whether the records are relevant and material to the action. The provisions of the bill do not apply to certain government entities, such as district attorneys and their assistants, in the furtherance of their official functions.
