Bill Summary

A BILL To require regulation of wastes associated with the explo- ration, development, or production of crude oil, natural gas, or geothermal energy under the Solid Waste Dis- posal Act, and for other purposes.

AI Summary

This bill, the CLEANER Act of 2021 or the Closing Loopholes and Ending Arbitrary and Needless Evasion of Regulations Act of 2021, requires the Environmental Protection Agency (EPA) to determine whether certain wastes associated with the exploration, development, or production of crude oil, natural gas, or geothermal energy meet the criteria for being classified as hazardous waste. The bill then requires the EPA to identify or list those wastes as hazardous and to promulgate regulations for managing them under the Solid Waste Disposal Act, with the ability to modify the requirements to account for the special characteristics of these wastes. Additionally, the bill requires the EPA to revise the criteria for facilities that may receive drilling fluids, produced waters, or other associated wastes that are not identified or listed as hazardous, in order to protect human health and the environment.
