This bill aims to facilitate the creation of accessory dwelling units (ADUs) in single-family residential zones. It prohibits municipalities from banning or requiring a special permit for ADUs on lots larger than 5,000 square feet or of sufficient size to meet environmental regulations, as long as the single-family dwelling or ADU is occupied by a person with disabilities or an elderly person. The bill defines ADUs and sets size limits, while allowing municipalities to require owner occupancy and limit the total number of ADUs to at least 5% of non-seasonal housing units. Municipalities can also impose reasonable regulations on ADUs, such as setbacks and height restrictions, and may require one additional parking space, or retention of existing parking. Finally, the bill allows ADUs to be considered owner-occupied when the single-family dwelling is transferred to a trust with a beneficiary who is a person with disabilities or elderly.
