This bill aims to address visitation and family court matters in domestic violence cases. It proposes two new sections to Chapter 276 of the General Laws. Section 42B allows criminal courts to issue a ban on visitation rights for defendants charged or convicted of certain violent offenses, such as assault or rape, where the victim is pregnant or has a child in common with the defendant, or where a child is the victim or witness. The ban can be waived by the adult victim or the child's guardian, and can last up to one year after the defendant's sentence or until the defendant completes certain required programs. Section 87B establishes similar provisions for defendants placed on probation for these types of offenses.
