This bill prohibits employers from including in employment contracts provisions that waive an employee's substantive or procedural rights or remedies related to claims of discrimination, nonpayment of wages or benefits, retaliation, harassment, or violation of public policy. The bill makes such waivers unconscionable, void, and unenforceable, and allows employees to sue for attorneys' fees and costs if an employer attempts to enforce such a waiver. The bill also prohibits employers from retaliating against employees who refuse to enter into a contract with such a waiver, and gives the Attorney General and the Massachusetts Commission Against Discrimination the authority to enforce these provisions. The bill applies to contracts entered into on or after the effective date of the act.
