This bill aims to prevent medical bills from eroding an injury victim's compensation received through a settlement or court award. It amends Chapter 111 of the General Laws to limit the lien or right of reimbursement, subrogation claim, or recoupment that a health maintenance organization, group or individual medical insurer, or disability insurer can claim on any recovery or settlement obtained by the injured person. The bill stipulates that the insurer's claim cannot exceed the proportionate share of the recovery that the benefits provided bear to the total tort damages. It also allows either the entity that provided benefits or the injured person to petition the court for a determination of the reasonableness of the settlement and the fair allocation of amounts payable.
