This bill amends the Massachusetts General Laws to establish stricter requirements for local boards of health to adopt on-site sewage disposal system regulations that exceed the standards set forth in the state's Title 5 Environmental Code. Specifically, the bill requires the Department of Environmental Protection to review and approve any such proposed local regulations, based on findings that the regulations have a scientific basis, are best practices, protect unusual local resources, and do not conflict with the state code. The bill also establishes an appeals process for decisions made under local wetlands ordinances or bylaws, which are to be appealed to the Department of Environmental Protection under the state's Wetlands Protection Act.
