This bill aims to prevent the sexual abuse of children and youth by adults in positions of authority or trust. The key provision is that a person over the age of 21 who is employed by or contracted with a public or private school, the Department of Youth Services, the Department of Children and Families, the Department of Mental Health, the Department of Developmental Services, or a private institution that provides services to clients of such departments, and who is a teacher, administrator, or in a similar position of authority, will have a cause of action against them under Chapter 260, Section 4C if they engage in sexual relations with a person under the age of 19 who has not received a high school diploma, GED, or equivalent, and is served by the school, department, or institution, or a person under the age of 22 with special needs who has not received a high school diploma, GED, or equivalent, and is served by the school, department, or institution. In such civil actions, the person served by the school, department, or institution will be deemed incapable of consent to sexual relations with the employee or contractor.
