This bill amends Section 28E of Chapter 278 of the Massachusetts General Laws to address the costs of appeals by the Commonwealth. Under the amended law, a defendant who is not indigent and not entitled to public representation is responsible for their own costs on appeal, unless the Commonwealth loses the appeal or its application is denied. In such cases, the defendant is entitled to be reimbursed for the costs they incurred, including reasonable attorney's fees, subject to court approval.
