This bill proposes to amend Massachusetts state law to indemnify (protect from liability) parents and legal guardians who follow the medical care recommendations of licensed healthcare providers for their children. The bill states that parents or guardians cannot be charged with abuse or neglect if they have sought care from a licensed provider, the provider has made a diagnosis and prescribed treatment, and the parent/guardian is following or willing to follow that recommended treatment. The bill also prevents mandatory reporters (such as teachers) from filing abuse or neglect reports solely based on a parent's decision to follow their licensed provider's advice, except in cases of immediate life-threatening conditions where there is clear evidence the provider's recommendation should be overridden.
