This bill aims to amend Chapter 40B of the General Laws in Massachusetts to provide a presumption of consistency with local needs for the denial of waivers from municipal natural resource protection bylaws or ordinances that are adopted and approved under Section 32 of Chapter 40. The purpose of these bylaws, ordinances, or regulations must be to protect and promote the "Waters of the Commonwealth," including wetlands, surface waters, and groundwater, as defined in Section 26A of Chapter 21. This change is intended to help preserve wetlands and water resources in certain housing applications under Chapter 40B.
