This bill enacts the "gender identity respect, dignity and safety act" which relates to the treatment and placement of incarcerated individuals based on their gender identity. It requires that incarcerated individuals with a gender identity different from their assigned sex at birth be addressed and provided access to items consistent with their gender identity. The bill also establishes a presumption that these individuals be placed in correctional facilities with persons of the gender that most closely aligns with their self-attested gender identity, unless they opt out or are determined to present a current danger of committing gender-based violence. The bill prohibits denying placement or transferring individuals out of their presumptive placement as a form of discipline and provides avenues for individuals to challenge denials of presumptive placement. It also requires annual reporting on denials and opt-outs of presumptive placement, as well as training for correctional personnel.
