This bill, the Protecting Critical Boards and Electronics Through Transparency and Enduring Reinvestment Act of 2021 (PCBETTER Act of 2021), establishes an Electronics Supply Chain Fund to provide funding for the domestic manufacturing of semiconductors, microelectronics, advanced electronic packaging, and printed circuit boards. It requires providers of certain systems to the Department of Defense to disclose the source of the printed circuit boards, particularly if they were manufactured in countries like China, Russia, North Korea, or Iran. The bill also directs the Department of Defense to test these systems for vulnerabilities and take remedial actions, including potential cost recovery from contractors if they should have reasonably discovered the vulnerabilities. Additionally, the bill requires contractors to undertake due diligence, such as security certifications and penetration testing, to prevent vulnerabilities in the goods and services they provide to the Department of Defense.
