This bill amends The Second Class Township Code to provide further provisions for surcharge by auditors and township managers. The key changes are: 1) Elected or appointed township officials cannot be surcharged if they acted in good faith based on a written, non-confidential opinion from the township solicitor, unless the solicitor's opinion was rendered under duress or involved collusion to violate the law. 2) The board of supervisors can appoint an individual, partnership, limited partnership, association, or professional corporation as the township manager, who will serve at the pleasure of the board. The board can enter into an employment or professional services agreement with the township manager that may include severance or termination provisions. The township manager is considered a public official under state ethics laws. 3) The restrictions on the township manager holding other township offices or employment apply to all officers and employees who directly provide services as required by the agreement, in the case of a partnership, limited partnership, association, or professional corporation serving as township manager.
