This bill requires contracting agencies to contact minority-owned and women-owned business enterprises (MWBEs) that are listed on a utilization plan when a contract is awarded. It also mandates that the prime contractor use the MWBE enterprises identified on the utilization plan, unless the enterprise cannot perform or is no longer state certified. The bill adds several new provisions, including requiring the prime contractor to execute a subcontractor's agreement and provide work assignments to the MWBEs within 45 days of the contract award, and making timely payments to the MWBEs within 20 days of receiving payment from the contracting agency. The bill also allows certain MWBE prime contractors to self-certify and perform work to meet the MWBE goals.
