This bill amends the Public Service Law to establish new requirements for major electric generating facilities that were permitted prior to 2012 and have provided notification that they are in layup or out of service. Under the bill, the certificate and air/water permits for these dormant facilities cannot be transferred, and the facilities cannot utilize fossil fuels to produce electricity or for other industrial purposes without obtaining a new certificate and permits. The bill aims to address the status and potential reactivation of older power plants that are not currently operational.
