This bill prohibits retail food business operators from serving food or beverages in foam polystyrene packaging, with some exceptions. It defines "foam polystyrene packaging" as packaging made primarily from foam polystyrene that is designed for serving or containing food or beverage, and "retail food business operator" as a person who operates a retail food establishment or a vending machine operator. The bill allows the Department of Agriculture, Trade and Consumer Protection to grant waivers to retail food business operators if the department determines that the waiver is necessary to avoid an undue hardship or practical difficulty. The bill also establishes penalties for violations, with a maximum forfeiture of $250 for the first violation more than 90 days after receiving written notice, and $500 for each subsequent violation more than 180 days after the written notice. The bill takes effect on the first day of the 13th month after publication.
