Bill Summary

AN ACT to amend the education law, in relation to pendency placements in a school district in a city having a population of one million or more

AI Summary

This bill amends the Education Law to provide a presumption that the school identified in a settlement agreement is the student's operative placement for the purposes of "pendency" (continuation of the student's prior educational placement during an appeal process) in a school district in a city with a population of one million or more. The bill also requires periodic review of the student's Individualized Education Program (IEP), sets parameters for pendency payments, and imposes deadlines for the school district to finalize settlements or inform parents regarding pending claims for tuition reimbursement from the 2020 school year or earlier.
