This bill amends the Retirement and Social Security Law to grant New York City Transit Authority (NYCTA) employees who are members of the New York City Employees' Retirement System (NYCERS) and participated in World Trade Center (WTC) rescue, recovery, or cleanup operations a performance of duty disability retirement allowance equal to 75% of their final average salary. The bill also allows these eligible NYCTA members and retirees to use the Final Medical Review procedures to appeal NYCERS' WTC disability benefit determinations. The bill's enactment would increase the present value of future benefits for 39 pensioners who have been approved for WTC benefits by approximately $8.3 million and increase the average annual employer contributions by approximately $31,600 for each new WTC benefit approved under the proposed legislation.
