This bill enacts the Comprehensive Insurance Disclosure Act, which requires defendants, third-party defendants, or defendants on a cross-claim or counter-claim to provide plaintiffs, third-party plaintiffs, and other parties with notice and proof of the existence and contents of any insurance agreement that may be liable to satisfy part or all of a judgment within 60 days of serving an answer. The information to be provided includes details on all primary, excess, and umbrella policies, as well as coverage amounts, lawsuits that have reduced the available coverage, and any payments of attorney's fees that have eroded the policy value. The bill also imposes an ongoing obligation to update this information throughout the litigation. The information provided must be certified as accurate and complete by the defendant and their attorney.
