This bill amends the 1897 Public Act 180, which provides for the issuance of marriage licenses and certificates without publicity in certain cases. The key provisions of this bill are: 1. It allows the probate judge to issue a marriage license without publicity if a person desires to keep the exact date of their marriage a secret, as long as there is a good reason expressed in the application and determined to be sufficient by the probate judge. 2. It allows the probate judge to marry, without publicity, persons under the marriageable age, if the application for the license is accompanied by a written request from the biological or adopting living parents, or the guardians if either or both parents are dead. 3. It clarifies the consent requirements for a noncustodial parent, stating that the consent is only required from the parent to whom custody of the child has been awarded by a court, and not from a parent confined in a penal institution or psychiatric hospital, or if they cannot be found after a diligent search. 4. It authorizes the probate judge to issue an order nunc pro tunc (retroactively) regarding the date to appear on the marriage license. The bill also includes an enacting section stating that this amendatory act does not take effect unless a specific Senate or House Joint Resolution becomes part of the state constitution.
