This bill relates to the rights of parties involved in foreclosure actions and provides additional details regarding the commencement and termination of certain actions related to real property. Specifically, it amends the Real Property Actions and Proceedings Law to clarify that the prohibition on commencing or maintaining another action to recover any part of the mortgage debt does not affect the calculation of the statute of limitations period. It also adds a new provision to the Civil Practice Law and Rules that allows a plaintiff to commence a new action within six months of the termination of a prior timely-filed action on the same transaction or occurrence, and allows the defendant to timely assert any defenses or causes of action from the prior action in the new action.
