This bill, the "Exposing China's Belt and Road Investment in America Act of 2021," amends the Defense Production Act of 1950 to include certain investments by the People's Republic of China (PRC) in the definition of "covered transactions" that must be reviewed by the Committee on Foreign Investment in the United States (CFIUS). Specifically, the bill covers transactions involving the purchase or lease of private or public real estate in the United States and the establishment of a U.S. business to operate a factory or other facility on that real estate, if the transaction could result in control of the U.S. business by the PRC government or related entities. The bill also defines the "Government of the People's Republic of China" to include national and subnational governments, and requires parties to such transactions to submit a declaration to CFIUS.
