This bill amends the Health Care Facilities Act to require ambulatory surgical facilities and hospitals to adopt and implement policies to prevent exposure to surgical smoke through the use of smoke evacuation systems for each procedure that generates such smoke. The Department of Health will ensure compliance with this requirement during on-site inspections and in response to any complaints received. The bill defines "smoke evacuation system" as equipment and technologies designed to capture, filter, and remove surgical smoke at the site of origin, and "surgical smoke" as the surgical plume generated from the use of energy-generating surgical devices, including smoke plume, bio-aerosols, laser-generated airborne contaminants, and lung-damaging dust.
