This bill establishes provisions regarding businesses failing to pay arbitration fees. If a business that is required to pay certain fees and costs before an arbitration can proceed fails to do so within 30 days, the business is considered in material breach of the arbitration agreement and waives its right to compel arbitration. In such cases, the employee or consumer can either withdraw the claim from arbitration and proceed in court, or compel the business to continue the arbitration and pay the employee or consumer's reasonable attorney's fees and costs. If the employee or consumer proceeds in court, the court must impose sanctions on the business, which can include monetary sanctions, evidence sanctions, and terminating sanctions.
