Bill Summary

This bill allows plenary and out-of-State wineries that annually produce 495,000 or less gallons of wine to directly ship their products to consumers and have salesrooms apart from the winery premises. Under current law, small plenary wineries that produce 250,000 gallons or less per year and farm wineries are permitted to directly ship wine to New Jersey residents and consumers residing in other states. In addition, out-of-State wineries that annually produce 250,000 gallons or less may obtain a license to directly ship wine to New Jersey residents. These small plenary wineries also may sell wine at retail in original packages in 15 salesrooms located apart from the winery premises; out-of-State winery license holders may operate up to 16 sales rooms. Wineries that produce more than the 250,000 gallon capacity cap are prohibited from directly shipping wine or operating salesrooms. Current law also prohibits wineries that produce 250,000 gallons or less per year from owning an interest in a winery that produces more than 250,000 gallons per year. This bill increases the capacity cap by allowing the holder of a plenary winery license or an out-of-State winery that annually produces up 495,000 gallons to directly ship up to 12 cases of wine to consumers over the age of 21 and operate separate salesrooms. Additionally, wineries that produce less than 495,000 gallons per year would be prohibited from owning an interest in wineries that produce more than 495,000 gallons per year.
