This bill creates the Office of the Homeowners' Association Ombudsman within the Division of Florida Condominiums, Timeshares, and Mobile Homes of the Department of Business and Professional Regulation. The Governor will appoint an attorney admitted to practice before the Florida Supreme Court as the Ombudsman, who will serve at the pleasure of the Governor. The Ombudsman will have various powers and duties, including accessing division records, preparing reports and recommendations, acting as a liaison between parties, monitoring and reviewing election and meeting procedures, and assisting with dispute resolution. The bill also establishes an election monitoring process, where 15% of the total voting interests in a homeowners' association or six parcel owners can petition the Ombudsman to appoint an election monitor to attend the annual meeting and conduct the election of directors, with the association bearing the costs.
