This bill aims to protect individuals and organizations from "Strategic Lawsuits Against Public Participation" (SLAPP suits), which are lawsuits filed with the intent to inhibit their First Amendment rights to free speech and petition. The bill defines a SLAPP suit, provides exemptions where a lawsuit is not considered a SLAPP suit, and allows defendants to file motions to dismiss SLAPP suits. The bill also requires the court to award attorneys' fees and costs to the defendant if the court determines the motion to dismiss is justified, and to the plaintiff if the motion is found to be frivolous. The bill will only apply prospectively to causes of action arising after its effective date of October 1, 2022.
