This bill aims to protect students and employees at institutions of higher education in South Dakota from "divisive concepts". The bill defines "divisive concepts" as ideas that suggest any race, color, religion, sex, ethnicity, or national origin is inherently superior or inferior, or that individuals should be discriminated against or made to feel guilt or distress based on their race, color, religion, ethnicity, or national origin. The bill prohibits institutions under the control of the Board of Regents or Board of Technical Education from requiring students or employees to affirm or adhere to these divisive concepts, or from using funding for purposes that violate the Act. However, the bill clarifies that it does not prevent responding to questions about these concepts during mandatory training, does not pertain to academic course content, and does not intend to violate First Amendment rights or undermine academic freedom.
