Bill Summary

AN ACT To amend chapter 407, RSMo, by adding thereto two new sections relating to electronic literary product licenses, with penalty provisions.

AI Summary

This bill creates new provisions in Missouri law relating to the licensing of electronic literary products. It requires publishers who offer to license electronic literary products to the public to also offer to license those products to public libraries on reasonably similar terms, including price, license duration, and availability. The bill allows publishers to include certain reasonable limitations in the license terms, such as limiting the number of simultaneous users or access days, and requiring the use of technological protection measures. However, the bill prohibits publishers from limiting the number of licenses a public library can purchase. Violations of these provisions would constitute an unfair, abusive, or deceptive trade practice subject to enforcement under existing law.
