This Joint Resolution proposes to amend the Constitution of New Mexico by adding a new section to Article 2, which would establish environmental rights for all people of the state, including the right to a clean and healthy environment encompassing elements like water, air, soil, and climate, as well as the right to protect the environment's natural, cultural, scenic, and healthful qualities. It also declares the protection of the state's environment to be of fundamental importance to public health, safety, and interest, and directs the state, including its local governments, to act as a trustee of New Mexico's natural resources, responsible for conserving and protecting them for the benefit of all current and future New Mexicans. Furthermore, this resolution would repeal the existing pollution control provisions found in Article 20, Section 21 of the constitution, and the proposed amendments would be put before the voters for approval or rejection at the next general or a called special election.
