This bill, titled the Nebraska Human Life Protection Act, would amend existing state law to make it unlawful for any person to administer or use any means to intentionally cause the termination of an unborn child's life, with certain exceptions to protect the life of the mother. The bill defines an "unborn child" as a living human from fertilization to birth. It would impose a Class IIA felony penalty for violations, but would not hold the pregnant woman liable. The bill would only become operative if the U.S. Supreme Court overrules Roe v. Wade, an amendment to the U.S. Constitution is adopted, or Congress grants Nebraska the authority to regulate abortion to the extent provided in the act. The bill also amends the definition of "unprofessional conduct" for licensed medical professionals to include performing an abortion in violation of this new Nebraska Human Life Protection Act.
