This bill allows the Department of Environmental Protection to promulgate legislative rules to establish increased civil administrative penalties for repeat violations and potential for accumulative impacts on larger, more sophisticated projects. The bill specifies that for projects impacting 100-500 acres, penalties will be twice as high, and for projects of 500 acres or more, penalties will be 5-10 times higher than for smaller projects. Additionally, the bill provides for further penalty increases for actions involving 10-100 violations (additional factor of 2) and 100 or more violations (additional factor of 5). These increased penalty ranges are intended to more effectively deter future violations for large, complex projects with greater potential for accumulative environmental impacts.
