This bill creates a new first-degree crime of "home invasion" that applies when a person enters or remains in a residential dwelling with the intent to commit certain serious crimes, and does so while a person other than the perpetrator is present and the perpetrator uses force, threatens bodily injury, commits a first or second-degree crime, or is armed with a deadly weapon or explosive. The bill also upgrades the crime of burglary of a residence to a second-degree crime in certain circumstances and makes the new home invasion crime subject to the No Early Release Act, which requires a person convicted of the crime to serve at least 85% of their sentence before being eligible for parole.
