This bill legalizes the possession of six or fewer marijuana plants, subject to the enactment of legislation legalizing marijuana or cannabis for personal use. The bill also specifies that the odor of marijuana or hashish alone does not constitute reasonable suspicion to initiate a search, and that a person who possesses six or fewer ounces of marijuana or 17 grams or less of hashish cannot be arrested, detained, or have their legal or civil rights affected solely for that violation. The bill further clarifies that drug paraphernalia used or intended for use with marijuana or cannabis is presumed to be lawful cannabis paraphernalia, unless the object is in proximity to an illegally possessed controlled substance.
