This bill prohibits the release of illegal immigrants from correctional facilities in New Jersey, except into the custody of U.S. Citizenship and Immigration Services. It requires correctional facility administrators to determine the citizenship and legal status of all inmates, and to detain any inmates who are not U.S. citizens or lawfully present in the United States. The bill also authorizes the Commissioner of Corrections to impose civil penalties on administrators who release such inmates in violation of the law, and directs the Commissioner to promulgate rules and regulations to implement the new requirements.
