This bill amends existing New Mexico law to require the inclusion of a plea of guilty to brandishing a firearm in any related guilty plea for a noncapital felony. It specifies that when a separate finding of fact shows a firearm was brandished in the commission of a noncapital felony, the basic sentence of imprisonment shall be increased by three years, or five years for a second or subsequent offense. The bill also defines the term "brandished" to mean displaying or making a firearm known to another person while the firearm is present on the person of the offending party with intent to intimidate or injure a person.
