This bill creates the crime of "Unlawful Access to a Firearm by a Minor" in New Mexico. The key provisions are: (1) it is unlawful for a person to keep or store a firearm in a manner that allows a minor to access it without the authorization of the minor's parent or guardian, or when the firearm is used in the commission of a crime; (2) the person who keeps or stores the firearm is subject to a $1,000 penalty assessment if the firearm is accessed by a minor without authorization, unless the person had no reasonable expectation that a child would be present; (3) the person commits a misdemeanor offense if the firearm is accessed by a minor and used in the commission of a crime; and (4) the penalty assessment can be enforced by a citation or a civil fine, with the cost of a firearm storage device credited against the assessment or fine.
