This bill amends New Mexico's Educational Retirement Act to allow certain retired members to return to employment with a local administrative unit without suspending their retirement benefits. The key provisions are: 1. Retired members who retired on or before January 1, 2001, and have not suspended their benefits, can return to work without a suspension of benefits. 2. Retired members who have not worked for a local administrative unit for at least 12 consecutive months can return to work without a suspension of benefits. 3. Retired members can return to work for up to 36 months total (consecutive or non-consecutive) without a suspension of benefits, as long as they have not worked for a local administrative unit for at least 90 days after retirement. The bill also requires retired members and their employers to continue making contributions to the retirement and retiree health care funds during the period of employment.
