This Memorial requests the Public Education Department to create a detailed plan to improve education for four groups of students identified as "at-risk" in the Yazzie/Martinez v. State of New Mexico court case: Native American students, English language learners, students with disabilities, and low-income students. This plan, which must be developed by June 1, 2022, and in consultation with the plaintiffs in the lawsuit, should outline specific goals, actions, timelines, staffing needs, accountability measures, and the funding required to address the educational deficiencies identified by the court. The Memorial also mandates that the Public Education Department work with the Higher Education Department to address teacher shortages and report annually to the legislature on the plan's implementation and the state's progress in providing a sufficient education to these at-risk students, as required by the New Mexico Constitution.
