Bill Summary

AN ACT To repeal section 376.1800, RSMo, and to enact in lieu thereof one new section relating to retainer agreements for the provision of health care services.

AI Summary

This bill repeals and replaces an existing Missouri law to allow dentists, in addition to chiropractors and physicians, to enter into medical retainer agreements with patients. A medical retainer agreement is a contract where the provider agrees to provide certain healthcare services to an individual patient for an agreed-upon fee and time period. The bill specifies the requirements for such agreements, including that they must be in writing, allow for termination, and clearly state that they are not health insurance. The bill also allows patients to pay for the retainer agreement using health savings accounts, flexible spending arrangements, or health reimbursement arrangements, and permits employers to contribute to or directly pay these fees.
