This bill requires the disclosure of certain information when an agency responds to a request for law enforcement disciplinary records, including information a victim alleges regarding sexual misconduct. Specifically, the bill prohibits agencies from denying access to such records on the grounds that they constitute an unwarranted invasion of personal privacy, are compiled for law enforcement purposes, are inter-agency or intra-agency materials, are designated as confidential or private by a private agreement, or were created prior to the effective date of this law. The bill also adds a new provision requiring the disclosure of the name or other personal identifying information of a person included in a law enforcement disciplinary record who is alleged to have been the victim of sexual misconduct, which is defined to include various forms of sexual harassment, assault, and other misconduct.
