This bill creates a new section in KRS Chapter 311 to establish the crime of "fraudulent assisted reproduction." This occurs when a healthcare provider performing an assisted reproduction procedure knowingly uses a donor's reproductive material without the patient's consent or uses their own reproductive material without the patient's knowledge and consent. The bill provides a civil cause of action for patients, their spouses/partners, the resulting children, or the donor whose material was used without consent. Damages can include $10,000 in liquidated damages plus the costs of the fertility treatment and attorney's fees, or compensatory and punitive damages. The bill also amends KRS 311.597 to add fraudulent assisted reproduction to the list of violations that may cause a doctor to lose or have their medical license restricted.
