Bill Summary

AN ACT To amend Title 20 of the Official Code of Georgia Annotated, relating to education, so as to provide that it shall be unlawful for Georgia public schools or participating private schools whose students or teams compete against a Georgia public school to operate, sponsor, or facilitate athletic programs or activities that permit a person of one gender to participate in an athletic program or activity that is designated for persons of the opposite gender; to provide for exceptions; to provide for private rights of action and awards of attorney fees; to provide for legislative findings and intent; to provide for definitions; to provide for a short title; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill aims to prohibit Georgia public schools and participating private schools from operating, sponsoring, or facilitating athletic programs or activities that allow a person of one gender to participate in a program designated for the opposite gender, with some exceptions. It defines "gender" based on a person's biological sex at birth, as stated on their birth certificate. The bill provides a private right of action for aggrieved students or their parents to seek injunctive or declaratory relief and recover attorney's fees if they prevail. The bill also includes legislative findings that recognizing the physical differences between males and females, and promoting fairness and safety in sports, are important state interests.
