Bill Summary

AN ACT To amend Title 36 of the Official Code of Georgia Annotated, relating to local government, so as to prohibit certain use restrictions on residential dwellings; to provide for definitions; to provide a limited waiver of sovereign immunity; to provide for interest prior to judgment; to provide for revocation of qualified local government status for a violation; to provide for reinstatement of qualified local government status under certain conditions; to provide for the promulgation of rules and regulations; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill prohibits local government entities in Georgia from enacting or enforcing any restrictions on land or dwellings that are subject to long-term residential rental agreements (at least 12 months). It also makes it unlawful for local governments to prevent a person from occupying a dwelling based solely on whether they own the dwelling or not. The bill waives the sovereign immunity of local government entities to the extent necessary to effectuate this law, with a cap of $1 million per occurrence on damages. It allows for the recovery of interest prior to judgment and provides for the revocation and potential reinstatement of a local government's qualified status under Georgia's Department of Community Affairs if it violates this law.
