This bill prohibits compelling a person to identify or provide information related to an individual who has sought or obtained an abortion if the information is being requested based on another state's laws that interfere with a person's right to choose or obtain an abortion or a foreign penal civil action. The bill authorizes the Insurance Commissioner to assess a civil penalty against an insurer that discloses an insured's confidential medical information. It also prohibits healthcare providers, plans, contractors, and employers from releasing medical information identifying an individual seeking or obtaining an abortion in response to a subpoena or request based on another state's laws or a foreign penal civil action. Additionally, the bill prohibits prison staff from disclosing identifying medical information related to an incarcerated person's right to seek and obtain an abortion if the information is being requested based on these same grounds. The bill also incorporates changes to the Code of Civil Procedure regarding the issuance of subpoenas related to foreign penal civil actions.
