This bill adds a new section to existing Idaho law to provide for the expungement of certain disciplinary actions related to occupational licensing. The key provisions include: - Licensing authorities can grant requests to expunge prior disciplinary actions, including formal, informal, corrective, or disciplinary actions. - For disciplinary actions related to failure to timely renew a license or complete continuing education, the licensing authority must expunge the record if the action is at least 3 years old, the terms have been met, and there have been no subsequent violations. - For other types of disciplinary actions, the licensing authority may expunge the record if the action is at least 7 years old, the terms have been met, and there have been no subsequent violations. - Expungement prohibitions apply to disciplinary actions based on criminal convictions enumerated in state law. - Expunged disciplinary actions will be removed from national databases, and the licensee will not have to report them on future applications. The bill also declares an emergency and states that it will take effect on July 1, 2022.
