This bill amends and adds to existing Idaho law to provide restrictions on the use of rental application fees and background check fees by landlords, property managers, and owners. The key provisions include: (1) allowing a landlord or property manager to charge a rental application fee to the first applicant if they disclose the rental criteria in advance; (2) allowing the landlord or property manager to charge application fees to multiple prospective tenants in certain circumstances, such as if the unit is not yet rented and the applicant is a backup offer, or if the applicant agrees to be placed on a waiting list; and (3) limiting landlords or property managers to processing only two background checks at a time for an available rental unit. The bill also allows tenants or applicants who have paid an application fee to take legal action against the landlord, property manager, or owner for violations of these provisions.
